Application For Summoning Witness

MOST RESPECTFULLY SHOWETH:

1. That the Accused, in his defence, besides other witnesses, intends to examine one, Shri XXXX, a former employee with M/s XXXXXXX, who was the dealing official with the complainant on behalf of the said loaning institution.
2. That since the witness to be summoned is an official witness, therefore assistance of the court is required to ensure the presence of the abovementioned witness along with requisite documents/records/file(s).
3. That however the accused could not fetch the summoning address of the said witness. He undertakes to file the same before this Hon’ble Court within one week.
4. That the accused further undertakes to pay diet money to the witness in the court upon appearance.
It is, therefore, prayed that the Hon’ble Court may kindly be pleased to order for issuing a summons to the witness mentioned in Para 1 above to appear before the Hon’ble Court along with the summoned record on the next date of hearing.
